REFUND POLICY

1. General Principle for Digital Content (All Sales Are Final)

Due to the nature of digital products (3D models in STL format, digital downloads, memberships, and commercial use licenses), all sales and subscription payments made via the Whop.com platform are final. Since digital products are made available immediately upon purchase and cannot be physically returned, we generally do not grant refunds, credits, or cancellations for billing periods that have already been paid.

2. Expiry of the Right of Withdrawal (Important for EU/UK Customers)

Consumers residing in the European Union (EU) or the United Kingdom (UK) expressly agree at the time of purchase that the provider (Dream New Art) will begin fulfilling the contract (providing access to the digital files or the Discord server) immediately after payment.

The customer acknowledges and agrees that their statutory right of withdrawal expires completely upon the start of the download or access to the provided digital content (in accordance with Art. 16 lit. m of the EU Consumer Rights Directive and § 356 para. 5 of the German Civil Code – BGB).

3. Exceptions & Technical Issues

A refund will only be reviewed and granted in the following exceptional case:

  • Verifiably Defective Files: If a digital file (e.g., a 3D model) has a significant technical defect that makes its use impossible (e.g., corrupted file, mesh errors), and the provider is unable to fix this error within a reasonable period of time after being notified in writing.
  • Burden of Proof: The burden of proof regarding an irreparable technical defect lies with the customer. Simply disliking the design or incompatibility with the customer’s software/hardware (which was not specified as supported prior to purchase) does not constitute a defect.

4. Subscriptions & Cancellations

  • Cancellation Period: Active subscriptions can be canceled at any time prior to the end of the current billing cycle (monthly or yearly) directly via the customer’s Whop dashboard.
  • No Pro-Rata Refunds: Following a cancellation, access to the digital content and licenses will remain active until the end of the already paid billing cycle. A pro-rata refund for unused days within an already started billing period is excluded.

5. Abuse and Unauthorized Chargebacks

 If a customer attempts to reverse a lawful payment through their payment provider (e.g., credit card company, PayPal, Stripe) without contacting us first (so-called chargeback or friendly fraud), the provider reserves the right to:

  • Immediately and permanently ban the Whop account and revoke access to all digital files and the Discord server.
  • Revoke the commercial use license with immediate effect.
  • Legally claim any incurred chargeback fees as well as the outstanding balance.
